II. DEFINITIONS
A. Foreign Students (As Defined, Classified and Restricted by the U.S. Immigration and Naturalization Service):
1. F-1 or F-2 Students
Non-U.S. citizens who are attending 91¶ÌÊÓƵ on a student visa. These students are eligible for hourly employment but are not eligible for work-study or financial aid.
2. J-1 or J-2 Students
Non-U.S. citizens who are attending 91¶ÌÊÓƵ on a visitor visa. These students are eligible for hourly employment but are not eligible for work-study or financial aid.
3. I-94 Students
Non-U.S. citizens who are "refugees," "adjustment applicants" or have been granted asylum in the U.S., and who possess an arrival/departure record from the U.S. Immigration and Naturalization Service. These students are eligible for hourly employment, work-study and financial aid.B. Work Permit
A permit issued by the U.S. Immigration and Naturalization Service which allows a Non-U.S. citizen to work in this country.C. Part-Time Hourly Employee
A non-salaried employee who is scheduled to work less than eight hours a day and is to be paid on the hourly payroll.D. Temporary Hourly Employee
A non-salaried employee who is scheduled to work eight hours a day but employed for less than one year and paid on the hourly payroll.E. Work-Study Participant
A 91¶ÌÊÓƵ student working under special funding and subject to special federal guidelines.F. Student Aide
A 91¶ÌÊÓƵ student employee who is not a work-study participant.G. Work-Study Program
A federal program which provides part-time jobs for eligible higher education students who require federal financial aid to pay their education expenses. Work-study is generally unavailable to most foreign students. However, foreign students having one of the following documents from the U.S. Immigration and Naturalization Service may participate in the work-study program:1. An alien registration receipt card (I-151 or I-551)
2. An arrival/departure record (I-94) showing status as a refugee, adjustment applicant or person granted asylum in the U.S.
Work-study applicants must be enrolled in six or more credit hours each quarter and (a) be making satisfactory progress toward the completion of a course of study, (b) not be in default on a student loan and (c) not owe a refund on a basic grant or supplemental grant at the school the student is planning to attend. A statement of educational purpose must be signed stating that the money received will be used only for tuition, fees, room, board, books, supplies and other expenses related to attendance at a particular school. "Need" is the difference between education expenses (tuition, fees, room, books, supplies, etc.) and the amount which the students and their families can afford to pay.
III. POLICY
A. In accordance with the U.S. Immigration and Naturalization Service guidelines, foreign students attending 91¶ÌÊÓƵ are eligible for on-campus employment as student aids and/or part-time/temporary employees even though they do not possess a work permit from that federal agency.
B. In accordance with said federal guidelines, any foreign student on a student visa (F-1 student) may accept up to 20 hours of such on-campus employment per week during the academic year and may also work full-time during the summer and other vacation periods. Such employment is authorized only if the student is in good academic standing, is enrolled in a full course of study and the employment will not displace a U.S. citizen or permanent resident. Scholarships, fellowships and assistantships are not considered on-campus employment for purposes of determining the amount of hours of employment worked.
C. All foreign student part-time/temporary employees or student aids are subject to hourly employment policies and procedures (see PPM 3-14).
IV. PROCEDURE
A. Work-study participants are selected through procedure outlined by the Financial Aid Department and supported by the U.S. Office of Education funding. Only I-94 students (refugees, adjustment applicants, or those granted asylum) are eligible for work-study positions.
B. All foreign student candidates for hourly jobs must apply for work through the 91¶ÌÊÓƵ Career Services Center for hourly on-campus employment. Final decisions to hire will be made within institutional guidelines by the requesting supervisor.
C. Pay rates for foreign student hourly employees will be consistent with those of other students in similar positions and must be approved by the director of Human Resources and the appropriate vice president or such other person as may be designated.
